Can One Heir Stop the Sale of an Inherited House in Florida?
By Yogi Ganeshram · 10/31/2026
It depends on who has legal authority over the house, what the will says, and whether the heirs co-own it. One heir can sometimes slow a sale, but rarely stop one forever.
Who has the authority
- During probate: the personal representative generally has authority to sell, subject to the will and court oversight. Heirs can raise objections, and the court can step in.
- After title passes to the heirs: if several heirs co-own the house, selling usually needs all of them to sign.
If heirs disagree
- Negotiate a buyout. One heir buys out the others.
- Mediate. A neutral mediator often saves time and legal fees.
- Partition. A co-owner can ask the court to order the property sold and the proceeds divided. It is slow and expensive, and it often takes many months.
What it costs to wait
Taxes, insurance, utilities, and upkeep do not stop. A vacant house can fall behind, which lowers the value everyone shares.
Better paths
- Agree on a timeline in writing.
- Get one independent price opinion everyone trusts.
- Split costs fairly while the house is on the market.
- Get legal advice early.
What to do this week
Write down who the heirs are, what the will says, and where the property stands. Send me the address, and I will show you what the house could net so everyone can decide with real numbers.
