I Inherited a House With Back Taxes in Florida: What Are My Options?
By Yogi Ganeshram · 10/31/2026
You have options, and the first clock to check is the tax deed timeline. Back taxes on an inherited house do not disappear when the owner passes away, and they keep moving toward a sale unless someone deals with them.
Start with these facts
- How much is owed and for which years. Ask the tax collector.
- Whether a tax deed application exists and when the sale is set.
- Who has legal authority. Probate may be needed to sell or manage the house.
Your options
- Pay the taxes and keep the house. Heirs and others with a legal interest may be able to pay to stop the process. Ask the clerk what documentation they need.
- Sell the house. The taxes are paid from the proceeds. If probate is open, the personal representative usually handles it, and court approval may be needed.
- Sell to a cash buyer who can move fast when probate and the tax timeline collide.
- Let it go to auction. Usually the worst route, because a surplus, if there is one, takes work to claim.
Common problems
- Several heirs disagree.
- Title is still in the name of the person who passed away.
- The house is vacant and falling behind on insurance or HOA dues.
What to do this week
Pull the tax payoff and the sale date, and find out whether probate is open. Then talk to a Florida probate attorney. If you want help on the sale side, send me the address and I will lay out the numbers.
Disclosure: I am a licensed REALTOR with eXp Realty, and I also invest in homes through my own company. If I am ever the buyer, I will tell you in writing before you decide.
