Can I Sell My House Before a Tax Deed Auction in Florida?
By Yogi Ganeshram · 10/31/2026
Yes. You can sell your house before a tax deed auction in Florida, as long as the sale closes and the back taxes are paid before the auction is completed. The taxes are paid out of your sale proceeds at closing, and the equity that is left is yours.
Why selling can beat waiting
At an auction, the house goes to the highest bidder, and you only receive what is left after taxes and costs, if there is a surplus at all. Selling on your own terms usually gives you more control over price and timing.
How it works
- Get the payoff. Ask the tax collector for the amount needed to clear the delinquent taxes and costs.
- Pick a path. List with an agent, sell to a cash buyer, or sell to an investor.
- Tell the title company early. They order the payoff, handle any other liens, and pay the tax collector at closing.
- Close before the auction date. Build in a cushion.
Time is the issue
A normal listing can take months. If the auction is close, a cash sale may be the only path that closes in time. Cash can close in a matter of weeks, but the price is usually lower than a full listing. Compare your net.
What to watch
- Other liens, like a mortgage, HOA, or code lien, also come out of proceeds.
- Occupied houses and probate cases take extra steps.
- Get any offer in writing and have a Florida attorney review it.
What to do this week
Pull the sale date and the payoff. Then send me the address and the numbers, and I will show you what you would net on a listing, a cash sale, and paying the taxes to keep the house.
